These Terms and Conditions of Use ("Terms") govern the access to and use of ASTRO - Intelligent DAW Assistant (the "Application") and its related licensing, hosting, and update services (the "Service"), provided by Pietro Mey ("Data Controller", "we", "our"). By downloading, installing, or using the Application, you agree to be bound by these Terms.

1. Description of the Service & Beta Disclaimer

Purpose: ASTRO is a voice-activated assistant designed to interact with Ableton Live via remote control scripts.

Beta Software Status: The Application is currently released as a Beta version. It may contain bugs, system errors, transcription imperfections, or unexpected behaviors.

Exclusion of Warranties: The Application is provided "as is" and "as available", without warranties of any kind, express or implied.

Workflow Responsibility: We are not liable for DAW crashes, loss of projects or data, interruption of recording sessions, or financial losses. It is your sole responsibility to perform frequent backups of your creative projects.

2. License and Intellectual Property

Grant of License: Subject to any applicable subscription fee, you are granted a limited, non-exclusive, non-transferable, and revocable license for personal use.
Restrictions: You may not decompile, reverse engineer, modify, distribute, or create derivative works without explicit written authorization.
Property: All intellectual property rights relating to the Application belong exclusively to the Data Controller.

3. Account, Subscription, and Billing

To access Premium features, you must create an account with a valid email address. Subscriptions are processed via Stripe and renew automatically unless cancelled before the renewal date.

Due to the digital nature of the software and the availability of a free tier, refunds are generally not granted after a subscription has been successfully processed, except as provided by consumer protection laws.

4. Technical Requirements

Proper operation requires: a compatible version of Ableton Live, correct installation of the remote control scripts, hardware meeting minimum specifications, and a working microphone. License verification and updates require an active internet connection.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the Data Controller shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from: (1) the use of or inability to use the Application; (2) errors in commands interpreted and executed on the DAW; (3) unauthorized access to or alteration of your data. The Data Controller's total liability shall not exceed the total amount paid by the user in the 12 months preceding the event.

6. Governing Law and Jurisdiction

These Terms are governed by Italian Law. For any dispute, the Court where the Data Controller resides shall have exclusive jurisdiction, without prejudice to consumer protection rights where applicable.

I presenti Termini e Condizioni d'Uso ("Termini") disciplinano l'accesso e l'utilizzo di ASTRO - Intelligent DAW Assistant (l'"Applicazione") e dei relativi servizi di licenza, hosting e aggiornamento (il "Servizio"), forniti da Pietro Mey ("Titolare"). Utilizzando l'Applicazione, accetti di essere vincolato dai presenti Termini.

1. Descrizione del Servizio & Esclusione Beta

Scopo: ASTRO è un assistente ad attivazione vocale per interagire con Ableton Live tramite script di controllo remoto.

Stato di Beta Software: L'Applicazione è rilasciata in versione Beta. Potrebbe contenere bug, errori di sistema, imperfezioni nella trascrizione o comportamenti imprevisti.

Esclusione di Garanzie: L'Applicazione viene fornita "così com'è" e "come disponibile", senza garanzie di alcun tipo.

Responsabilità sul Flusso di Lavoro: Non siamo responsabili per crash del DAW, perdita di progetti o dati, interruzioni di sessioni di registrazione o perdite economiche. È responsabilità esclusiva dell'utente effettuare backup regolari dei propri progetti.

2. Licenza d'Uso

Concessione: Ti viene concessa una licenza limitata, non esclusiva, non trasferibile e revocabile per uso personale.
Limitazioni: Non è consentito decompilare, disassemblare, modificare o distribuire l'Applicazione senza esplicita autorizzazione scritta.
Proprietà: Tutti i diritti di proprietà intellettuale relativi all'Applicazione appartengono esclusivamente al Titolare.

3. Account, Abbonamento e Fatturazione

Per accedere alle funzionalità Premium è necessario creare un account con un indirizzo email valido. I pagamenti sono gestiti tramite Stripe e si rinnovano automaticamente ogni mese fino a disdetta.

Trattandosi di contenuto digitale con attivazione immediata, il diritto di recesso di 14 giorni decade al momento dell'acquisto. Rimborsi discrezionali valutati caso per caso.

4. Requisiti di Sistema

Per il corretto funzionamento sono richiesti: Ableton Live (versione compatibile), corretta installazione degli script di controllo remoto, hardware conforme alle specifiche minime, microfono funzionante. La verifica licenza e gli aggiornamenti richiedono connessione internet attiva.

5. Limitazione di Responsabilità

Il Titolare non è responsabile per danni indiretti, incidentali, consequenziali o punitivi derivanti da: (1) uso o impossibilità di usare l'Applicazione; (2) errori nei comandi eseguiti sulla DAW; (3) accesso non autorizzato ai dati. La responsabilità complessiva non potrà in ogni caso superare l'importo pagato nei 12 mesi precedenti all'evento.

6. Legge Applicabile e Foro Competente

I presenti Termini sono regolati dalla legge italiana. È competente in via esclusiva il Foro del Titolare, fatti salvi i diritti dei consumatori.
